UK 'Patent Box' consultation
The UK Government is consulting on a preferential corporate taxation regime for profits arising from patents, known as a Patent Box. The intention is to introduce new rules in the Finance Bill 2012 and to apply them to relevant profits arising from 1 April 2013.
HM Treasury has set out five key questions on pages 51-54 of its consultation document “Corporation Tax Reform: delivering a more competitive system”. Comments are invited on:
- the conditions for patents to qualify for the regime
- the determination of income and implementation
- alignment with commercial incentives
- tax avoidance issues
